Definitions

In these Terms, unless the context requires otherwise:

• "App" / "Service": means the Kesari Dainik mobile application, website, APIs and related services provided by Kesari Dainik.
• "You" / "User": means any person or entity using the Service.
• "We", "Us", "Our": means Kesari Dainik and its affiliates, operators and representatives.
• "E-paper": means the digital newspaper issues, articles, images and edition files published or distributed by Kesari Dainik.

1. Introduction

Kesari Dainik provides digital access to e-paper editions, news content, and related services for readers. These Terms govern your access to and use of our Service. By accessing or using the Service you accept and agree to these Terms in full.

2. Acceptance of Terms

By installing, accessing, or using the Service you represent and warrant that you are capable of entering into a binding contract and are at least 18 years old or have parental/guardian consent. If you are using the Service on behalf of an organization, you agree you have authority to bind that organization to these Terms.

3. Accounts, Registration & Security

Certain features of the Service may require registration. When you register you must provide accurate, current and complete information. You are responsible for safeguarding your account credentials and for any activity that occurs under your account.

• Keep your password secure and do not share it.
• Notify us immediately at kesaridaily@gmail.com if you suspect unauthorized use of your account.
• We reserve the right to suspend or terminate accounts for violations of these Terms or for any conduct that we deem harmful to the Service or other users.

4. Privacy & Data

We collect and process personal data as described in our Privacy Policy. Personal data that may be collected can include your name, email and phone number (if provided), usage data, device identifiers and analytics data.

• We use collected data to provide and improve the Service, for analytics, customer support and communications.
• We DO NOT share your personal data with advertisers directly; third-party analytics or service providers may receive pseudonymized telemetry only as described in our Privacy Policy.
• You have rights to access, correct, or request deletion of your personal data. See the Account Deletion section for request instructions.

5. E-paper Content & Editorial Policy

KESARI DAINIK produces editorial content, including news articles, photographs, and layout. While we strive for accuracy and timely updates, we cannot guarantee content is free from errors.

All editorial decisions, including selection, editing, or removal of content, are at the editorial team's discretion and governed by internal editorial policies and applicable law.

6. Permitted Use

You may access and use the Service for personal, non-commercial reading and browsing of the e-paper subject to these Terms. Permitted uses include:

• Reading published e-paper editions and articles for personal use;
• Using built-in features of the App such as bookmarking, downloads for offline reading (where available), and sharing links to articles in accordance with these Terms;
• Interacting with features expressly provided by the App.

7. Prohibited Use

You must NOT:

• Use the Service for unlawful activities or to promote illegal content;
• Scrape, bulk-download, or systematically extract content without prior written permission;
• Reverse-engineer, decompile, disassemble or attempt to derive source code from the App;
• Remove, alter or obscure copyright notices or watermarks embedded in the content;
• Attempt to interfere with the security or integrity of the Service (including attempts to bypass access controls or rate limits).

8. User-Provided Content

If the Service allows you to submit or publish content (comments, feedback, or user contributions), you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute and display such content for the operation and promotion of the Service.

You represent that you own or have the necessary rights to submit content and that it does not infringe any third-party rights or applicable law. We may remove or moderate user content at our discretion and without prior notice.

9. Payments & Subscriptions

The App currently does not offer any paid subscriptions.

If we introduce paid services, subscription plans or premium features in the future, we will publish updated Terms and notify users. Any payments will be handled via third party payment processors (for example, Google Play). Refunds, billing and cancelation policies will follow the payment provider's policies and applicable consumer protection law.

10. Account Deletion & Data Removal

If you wish to delete your account and request removal of personal data, you may submit a delete request through our account deletion form: Delete Account.

Delete request requirements: When submitting a delete request you must provide:

• Your registered name;
• Email address used for registration;
• Phone number (if registered);
• Your account password (to verify identity).

Once you submit a delete request, our support team will manually verify the request to prevent fraudulent deletion. Typical processing time is 3–7 business days. We will notify you via email at the address provided when deletion is complete. Certain data may be retained where required by law (eg. tax, regulatory or archival requirements) or to protect against fraud.

11. Intellectual Property

All intellectual property rights in the Service (including trademarks, logos, UI design, software, editorial content, and images) are owned by Kesari Dainik or its licensors. Except as expressly provided, you are not granted any rights in the Service's intellectual property.

Requests for permission to reuse or republish editorial content should be directed to kesaridaily@gmail.com.

12. Advertising, Analytics & Third-Party Services

The Service may display advertisements or links provided by third parties. We are not responsible for third-party content, privacy practices or business models. Third-party services used by us (for analytics, crash reporting, CDN, etc.) operate under their own terms and privacy policies.

Where ads or sponsored content are shown, they will be identified as such. We may use aggregated, de-identified analytics to improve the Service. See our Privacy Policy for details.

13. Warranties & Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. KESARI DAINIK EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not guarantee the accuracy, completeness or timeliness of content.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL KESARI DAINIK, ITS OFFICERS, EMPLOYEES OR PARTNERS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES;
• LOSS OF DATA, PROFITS, REVENUE OR BUSINESS INTERRUPTION;
• ANY DAMAGES ARISING FROM THIRD-PARTY PRODUCTS OR LINKS;
• OR ANY CLAIM THAT THE SERVICE FAILED TO MEET YOUR REQUIREMENTS.

IN ALL CASES WHERE LIABILITY IS NOT EXCLUDED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED AN AMOUNT EQUAL TO INR 1,000 (ONE THOUSAND RUPEES) OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS (IF APPLICABLE), WHICHEVER IS LOWER.

15. Indemnity

You agree to indemnify, defend and hold harmless Kesari Dainik, its officers, directors, employees and agents from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees) arising out of or related to:

• Your breach of these Terms;
• Your misuse of the Service; or
• Any allegation that your content infringes a third party's rights or is unlawful.

16. Data Retention

We retain personal data as long as necessary to provide the Service, comply with legal obligations, resolve disputes, enforce our agreements, and for legitimate business purposes. When you request deletion, we will erase personal data subject to applicable retention obligations and lawful exceptions.

17. Children

The Service is not directed at children under the age of 13 (or the age required by local law). If you are a parent or guardian and believe a child under the permitted age provided personal data without consent, please contact us at kesaridaily@gmail.com.

18. Export Controls

You agree to comply with all export and import laws and regulations that apply to the application, including restrictions on destinations, end users and end use.

19. Links to Third-Party Sites

The Service may contain links to third-party websites or services that are not owned or controlled by Kesari Dainik. We are not responsible for the content, privacy practices or terms of those third parties. Links are provided for convenience only and do not constitute endorsement.

20. Changes to the Service & Terms

We may modify, suspend or discontinue the Service (or any part of it) temporarily or permanently for any reason. We will post material changes to these Terms on this page. Continued use of the Service after changes indicates your acceptance of the updated Terms.

21. Suspension & Termination

We may suspend or terminate your access to the Service without prior notice if you breach these Terms, violate applicable law, or for operational reasons. On termination, provisions which by their nature should survive (for example, Intellectual Property, Indemnity, Warranty Disclaimer, and Limitation of Liability) shall continue to apply.

22. Governing Law & Dispute Resolution

These Terms are governed by the laws of India without regard to its conflict-of-law rules. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of courts located in India, unless otherwise required by applicable law.

23. Notices

Notices under these Terms will be sent to the contact channels provided in your account or to the contact details listed below. We may also post notices on the Service. Notices are effective when delivered.

24. Severability & Waiver

If any provision is held invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver of our right to enforce it later.

25. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Kesari Dainik regarding the Service and supersede prior agreements.
